This Privacy Policy (“Policy”) of SUMA India Agitator Technology Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at A-47, Lower Ground Floor, Hauz Khas, South West Delhi, New Delhi, Delhi, India, 110016 (“SUMA India” or “Company” or “we” or “us” or “our”), has been drafted in accordance with the Information Technology Act, 2000, and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011.

 

The Policy is aimed at informing the users, unregistered visitors, and any person(s) (hereinafter collectively referred to as the “Users” or “you” or “your” or “yours”) using or accessing the website, https://www.suma-india.com/ (hereinafter, referred to as the “Platform”) about our practices in relation to the storage, use, processing, and disclosure of your Personal Data that may be accessed by us, or you may have chosen to share with us when you access or, use, or sign up for our Platform. For the purpose of this Policy, “Personal Data” shall mean any such data that relates to you, which, either directly or indirectly, in combination with other information available or likely to be available with us, is capable of identifying you.

1.2.    The Company shall bear no liability for the authenticity or accuracy of any Personal Data provided by you. Furthermore, the Company has no obligation to verify, and shall not be held responsible for verifying, any Personal Data received from you.

 

2.    THE PERSONAL DATA WE COLLECT ABOUT YOU AND HOW WE USE IT

2.1.    We collect, use, store, transfer, or otherwise process Personal Data about you to provide you with access and use of the Platform to the extent permissible under Applicable Law. 2.2.    If you provide us with information in connection with a job application, please refer to our Employee Specific Privacy Policy for details on how we process such data.

2.3.    We do not collect any financial information from you and advise you not to share any financial information with us. In the event that any financial information is inadvertently shared with us, we shall not be responsible for the security or confidentiality of such information.

2.4.    We may be required to use and retain Personal Data for legal and compliance reasons, such as the prevention, detection, or investigation of a crime; or fraud or respond to notices received from government authorities or investigation agencies. We may also use Personal Data to enforce our legal rights, meet our internal and external audit requirements, information security purposes, and as we otherwise believe to be necessary or appropriate:

  • Under applicable law, which may include laws outside your country of residence;
  • To respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include such authorities outside your country of residence. 

2.5.    You agree and acknowledge that any and all Personal Data pertaining to you, may be shared by us with our group companies for the purposes detailed in this Policy, in accordance with your consent where required under applicable laws.

2.6.    We endeavor to collect only such Personal Data that is reasonably necessary to perform services for you or to respond to your inquiries. You are responsible for ensuring that the Personal Data you provide is accurate and complete.

2.7.    Use of Third-Party Service Providers: We may engage third-party service providers for business support functions, including the creation of graphics, presentations, marketing materials, and other visual communication content through design platforms such as Canva Pty Ltd., Australia. In connection with such use, limited Personal Data voluntarily provided to us, including names, business contact details, photographs, or other content containing Personal Data, may be processed for the purpose of corporate communication and marketing activities. Such third-party service providers process Personal Data on our behalf under contractual obligations to implement reasonable security practices and procedures in accordance with applicable law. The use of such services may involve transfer of Personal Data outside India, subject to appropriate contractual and technical safeguards.

 2.8.   Use of Podcast Hosting / Player (Podigee):We may integrate podcast content on our Platform using the service provider Podigee GmbH, Revaler Straße 28, 10245 Berlin, Germany (“Podigee”). When you access a page on which a podcast is embedded or use the podcast player, the audio content is loaded from Podigee’s servers and made available for playback and transmission. As part of this process, Podigee may receive your IP address and certain technical information (such as browser and device data) that is required to deliver the podcast content. Where required under Applicable Law, such third-party services will be used on the basis of your consent and/or subject to appropriate contractual and technical safeguards for cross-border transfers.

 

3.    DATA RETENTION BY US

3.1.    You agree and acknowledge that your Personal Data will continue to be stored and retained by us for as long as necessary to fulfil our stated purpose(s).

3.2.    To determine the appropriate retention period for Personal Data, we consider the nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data, and the applicable legal requirements.

3.3.    Upon completion of the retention period for each category of Personal Data as described above, we shall delete or destroy, to the extent technically possible, Personal Data in our possession or control, or render the Personal Data into anonymized data, so that it no longer constitutes Personal Data, in which case we may use this information indefinitely without further notice to you.

5.    DISCLAIMER

5.1.    Company implements stringent security measures to safeguard the Personal Data you provide to us. However, Company shall not be liable for any breach of security during the transmission of Personal Data over the internet, including any unintended loss, misuse, alteration, or disclosure of such information.

5.2.    Furthermore, notwithstanding anything contained in this Policy, we shall not be responsible for any loss, damage, or misuse of data that arises due to (i) any force majeure event, (ii) any third-party hacking or unauthorized access, despite the implementation of reasonable security measures by us, or (iii) any act or omission on your part.

5.3.    We do not collect any Personal Data unless it is explicitly provided by you. 

 

6.    CHANGES TO THE PLATFORM AND THIS POLICY

We reserve the right to modify or amend the terms of our Policy from time to time. We recommend that you visit the website frequently to review this Policy periodically. In the event we modify this Policy, your continued use of the Platform will signify your acceptance of the modified Policy and will be adequate proof that you have expressly agreed to the terms of this Policy which shall apply from the date of your first use of the Platform.

11.    GOVERNING LAW AND JURISDICTION

This Policy shall be governed by the laws of India and the courts of New Delhi, India shall have the exclusive jurisdiction to try any dispute arising thereof.
